Senior Associate – Commercial Litigation and Tax Disputes


Our client is a rapidly expanding, forward-thinking law firm that collaborates closely with SMEs, banking and finance clients, debt collection agencies, High Court Enforcement Agencies, and Insolvency Practitioners.

Role Overview: We are seeking a Senior Associate to join the Commercial Litigation team, handling complex and substantial cases. The ideal candidate will have prior experience in junior or mid-level management roles and a comprehensive understanding of all facets of commercial litigation. This position requires a client-facing professional adept at managing inquiries confidently and possessing a proven track record in client development, complementing the firm's online optimization software and CRM system.

Key Responsibilities:

  • Team Leadership:

    • Oversee a small team managing a diverse range of commercial litigation cases, including director and shareholder disputes, partnership disputes, arbitration proceedings, complex contractual disputes, tortious claims, professional negligence, and injunctive proceedings (notably freezing order applications).
  • Client Interaction:

    • Engage directly with clients, managing inquiries from initial contact through to resolution, ensuring exceptional client service and satisfaction.
  • Case Management:

    • Conduct general commercial litigation (fast track and multi-track claims), demonstrating a thorough understanding of the Civil Procedure Rules (CPR) and their strategic application for clients.
    • Draft witness statements, interim applications (e.g., security for costs, further information, strike-out), and manage detailed disclosure exercises, including those under new pilot early and extended disclosure rules.
    • Facilitate mediation and alternative dispute resolution (ADR) processes, managing cases through to trial as necessary.
  • Specialized Disputes:

    • Handle shareholder and corporate disputes, including s.994 unfair prejudice petitions under the Companies Act 2006 and derivative claims.
    • Engage in tax tribunal proceedings, tax enforcement actions (such as winding-up and bankruptcy petitions), and negotiations with HMRC.

Qualifications and Experience:

  • Extensive experience in managing a team handling a broad spectrum of commercial litigation cases.
  • Demonstrated expertise in complex contractual disputes, shareholder and business disputes, arbitration, tortious claims, professional negligence, and injunctive proceedings.
  • Experience in tax disputes is highly desirable, with the ability to work across both commercial litigation and tax disputes teams.
  • Proficiency in client-facing roles, with a strong record of client development and relationship management.
  • Comprehensive understanding of the CPR and its strategic application in litigation.
  • Strong drafting skills for legal documents, witness statements, and interim applications.
  • Experience with mediation and ADR processes, and managing cases through to trial.
